These Terms & Conditions (“Terms”) govern your use of the Texas Porta Potty Rentals website and your rental of portable restroom units (“Equipment”) from us. By accessing our website or renting Equipment in Texas, you agree to be bound by these Terms.

1. Definitions

2. Rental Terms

2.1 Booking and Acceptance

Your rental is confirmed when we:

2.2 Rental Period

  • A reasonably level surface for placement

If we cannot access the Site due to conditions outside our control, additional fees may apply for repeated delivery or pickup attempts.

3.2 Placement of Equipment

We will place the Equipment in consultation with you, subject to safety and access requirements. We may refuse to place Equipment in locations that are unsafe, unstable, or inaccessible.

3.3 Pickup

At the end of the rental period, you agree to ensure the Equipment is accessible for pickup. If Equipment is blocked, moved, or otherwise unavailable, additional fees may apply.

4. Use of Equipment

You agree to:

  • Use the Equipment only for its intended purpose as a portable restroom facility
  • Prevent misuse, vandalism, or damage where reasonably possible
  • Do not relocate Equipment without our prior consent
  • Ensure that no foreign objects, hazardous materials, or non-human waste are deposited in the units

You are responsible for any loss or damage to Equipment beyond normal wear and tear.

5. Cleaning, Servicing, and Maintenance

We will deliver clean, sanitised Equipment and, where applicable, provide scheduled servicing during the rental period.

5.1 Servicing

For long-term rentals in Texas, service visits may include:

  • Pumping waste
  • Cleaning and sanitising
  • Restocking toilet paper and other consumables

The frequency of servicing is agreed upon at the time of booking. Additional servicing can be arranged upon request and may incur additional charges.

5.2 Customer Responsibilities

You agree to:

  • Report any issues, damage, or malfunctions promptly
  • Take reasonable care to keep the Equipment secure
  • Ensure that vehicles or obstacles do not block access for servicing

6. Fees, Payments, and Charges

6.1 Pricing

Pricing is provided in your quote and may include:

  • Rental fees (daily, weekly, or monthly)
  • Delivery and pickup charges
  • Servicing fees
  • Any applicable taxes

All prices are in the currency specified on your quote or invoice.

6.2 Payment Terms

Payment terms will be communicated at the time of booking. We may require full or partial payment before delivery, especially for first-time customers or event rentals in Texas.

Late payments may incur interest or additional charges as allowed by law.

6.3 Additional Fees

Additional fees may apply for:

  • Excessive cleaning due to misuse, vandalism, or neglect
  • Damage or loss of Equipment

  • After-hours, urgent, or emergency call-outs

7. Cancellations and Changes

  • Date or quantity changes are subject to availability and may affect pricing.

8. Limitations of Liability

  • We are not liable for any indirect, incidental, consequential, or special damages arising from your use of the Equipment or our website.
  • Our total liability for any claim related to a rental in Texas is limited to the amount you paid for the relevant rental period.

We are not responsible for delays or failure to perform due to circumstances beyond our reasonable control, including severe weather, natural disasters, or other force majeure events affecting Texas or surrounding areas.

9. Indemnity
